Merits of permit lawsuit will be heard May 12

There is a hearing at 9 a.m. May 12 on the merits of the case in Paul Petrovich’s suit against the City and SCNA in regards to the City denying a permit for a fueling station in Curtis Park Village. Afterward, Superior Court Judge Mike Kenny has 90 days to issue his judgment.

The judgment will either uphold the City’s decision to deny the permit, or vacate the City’s action and remand it back to the City, according to neighborhood attorney Patrick Soluri, who is representing Sierra 2.

“We are optimistic that the Court will uphold the City’s action,” Soluri said.
